If said finance.yahoo.com article is true, would it be ethical for SD to still advertise PTV and take on new customers, unless, of course, they have a different alternative up their sleeves?

This is probably why the all of a sudden silence on anything to do with PTV from SD. Maybe this will stop the "are we there yet" questions over and over

The whole Omniverse "we promise we have permission, look!" and the SD "well we saw the contracts" situation...yeah. How's that working out?

Without looking at the court filing again, I know at least Disney is one of the Plaintiffs in the case so the answer is, "No."

Well, hate to say it, but after reading the complaint filed I just cancelled my service for the Premium Channels. I will see how this plays out and if this gets thrown out (doubt that unless this guy produces these so called contracts his has) or if SD comes up with another legitimate solution. My subscription is up in 4 days.

Anyway, this will be interesting.

The plaintiffs in this case are going to have copyright claim to nearly the entirety of the Omniverse lineup. It is curious that Discovery Networks, which went dark on Omniverse months ago only to reappear on all sub-licensee platforms (except PTV), seemingly resolved whatever dispute they had. That being said, here's how this will probably go down.

Even if DeMeo does have this supposed "unicorn contract", the fact remains that it's causing problems for the programmers and they're getting an earful from mainstream OTT providers that have legitimate deals. They need this to go away. I suspect that their injunction will be granted, which immediately puts the whole operation on deathwatch. From there it's just a matter of litigating them out of business with their army of attorneys.

At the same time, there is an interesting bit of information that can be found in the filing is sections 15/16 (emphasis my own).

Defendant Omniverse was incorporated under the laws of the state of Delaware, but that status expired as of March 1, 2017 for failure to comply with corporate filing obligations. Omniverse was registered to do business in the state of Missouri by its President, DeMeo, with its principal place of business at 106 W. 11th Street, Suite 1700, Kansas City, MO 64105. That entity was dissolved November 4, 2015. Despite these lapsed registrations, Omniverse appears to be actively doing business, now as an unregistered sole proprietorship. Omniverse’s website lists its current place of business as 107 W. 9th Street, Second Floor, Kansas City, MO 64105.

Defendant DeMeo founded and was the CEO of Omniverse. He was registered to do business in Missouri under the fictitious name “Omniverse One World Television,” with the address of 233 SW Greenwich Drive, Lee’s Summit, MO 64082. That registration expired March 2, 2017. DeMeo appears to reside in or around Kansas City, MO. At all times relevant to this action, DeMeo has controlled Omniverse and upon information and belief is now its sole proprietor.

My guess is that omniverse have headend access somewhere and were pushing streams into one or 2 data centers that then SD was going to ultimately co-locate to for transcode.
So many options - just depends on what they (omniverse) think they were licensed to do.

I wonder if they are really going after damages from when the omnibox was around now that they won against DragonBox.
But in doing so they see an opportunity to close down the streaming distribution.
Ultimately I think @Pvaldez is right in that there will be a cease and desist issued to stop further potential damage to plaintiffs rights, and then slow death through litigation until they get to the heart of whatever they really want out of this - which I suspect is to close down anyone being able to charge $ for streaming their content when they want to do it themselves. Doesn't matter if omniverse has legal standing on getting access to content - it's very clearly about the streaming and recording of the content that's at stake here.

It's a pity it's going to come to this, but is hard to see an outcome where SD gets to keep premium TV as is.
Hopefully they're efforts on the other content continues, and maybe we see premium TV as something else in the future.

My sub is up in 4 days.. will probably boot strap 2 services until Mar-20 at least so I can start migrating off.. maybe something will happen by then though..
